Terms and Conditions for Employers Welccome to Jason Scott Associates, Inc. ("JSA"). This page states the complete Terms and Conditions of our services to you. Please review these Terms and Conditions carefully. By using our services, you acknowledge your acceptance of these Terms and Conditions. If you do not accept our Terms and Conditions, please do not use our services. - JSA is a contingency placement firm. (not a retained search firm) - You, as the employer, have complete authority, responsibility and control of your hiring decision. - JSA does not, in any way, make representations, recommendations, provide advice or make judgements on any of our candidates, in any way, including their experience, education, appearance, background or capabilities. - JSA does not perform any type of background, criminal, credit or other checks on our candidates, nor do we confirm any other information or credentials set forth on a candidate's resume. - Doing background checks, confirming information and making hiring decisions are the responsibility of the employer, and are performed at the sole discretion of the employer. - JSA does not represent or guarantee the truthfullness, accuracy or reliability of a candidate's resume or any other communications by or with a candidate, nor does JSA endorse any opinions expressed by a candidate. - You, as the employer, acknowledge that any reliance on material presented by JSA on behalf of a candidate will be at your own risk, and we ask that you perform any necessary background checks or confirmations that will enable you to make the best hiring decision. As an employer who has received information from JSA about one or more of our candidates, we prohibit you from using our candidate information: a) for any purpose other than as an employer seeking employees for your own business entity, and not for advertising, promotions, products or services; b) to make any unsolicited phone calls or other communications or to send unsolicited mail, email, faxes ornewsletters to our candidates or to contact our candidates unless they have expressly agreed to be contacted by you; or c) to source or contact our candidates or resume holders in regards to career fairs and/or business opportunities. You agree to indemnify, defend and hold JSA, its parents, subsidiaries, affiliates, officers, directors, agents and employees, harmless from any claims or demands of any third party, including, but nor limited to, attorney's fees and court costs, resulting from or arising out of your use of our services or your violations of any of these Terms and Conditions.
Terms and Conditions for Candidates Welccome to Jason Scott Associates, Inc. ("JSA"). This page states the complete Terms and Conditions of our services to you. Please review these Terms and Conditions carefully. By using our services, you acknowledge your acceptance of these Terms and Conditions. If you do not accept our Terms and Conditions, please do not use our services. You understand and agree that JSA: - does not warrant or guarantee that you will receive any employment or job offers through our services; - shall not be respnsible for any employment offers, employment screenings, employment decisions, background checks, educational confirmations and actual employment presented by potential employers; - does not guarantee the accuracy, completeness, validity, or timeliness of information listed by our employers, including, but not limited to, job openings and employment listings; and - is neither your employer or your agent in any regard. You shall use your own judgement, caution and common sense in evaluating any prospective employers and any information provided by them. You, as a candidate, acknowledge and agree that you are solely responsible for the form, content and accuracy of any resume or other communication provided to us, including any content, information and material contained in your resume, cover letter or any other communications with us (your "Data"). By using our services, you grant JSA a non-exclusive, royalty-free right and license to reproduce, adapt, distribute and publish your Data in any manner deemed appropriate by JSA. You agree to indemnify, defend and hold JSA, its parents, subsidiaries, affiliates, officers, directors, agents and employees, harmless from any claims or demands of any third party, including, but nor limited to, attorney's fees and court costs, resulting from or arising out of your use of our services or our use of your Data. JSA is not responsible for any results from your use of our services, whether good or bad. JSA reserves the right to refuse to accept, post, display or transmit any of your Data, in our sole discretion. If you do not wish to continue to use our services, you will provide written notice to that effect. In such event, JSA will use best efforts to discontinue any further use of your Data within a commercially reasonable period. |
